All matters listed hereunder constitute a consent agenda, and will be acted upon by a single roll call vote of the Board. Matters listed on the Administrative Agenda will be read only on the request of a member of the Board or the public, in which event the matter shall be removed from the Administrative Agenda and considered as a separate item.
Administrative Items
Consider recommendations regarding a First Amendment for Services of Independent Contractor with Community Health Centers of the Central Coast, as follows:
a) Approve and authorize the Chair to execute a First Amendment for Services of Independent Contractor with Community Health Centers of the Central Coast (a local vendor) to decrease the contract by $344,893.00 effective July 1, 2016 due to a change in Mental Health Service Act Prevention and Early Intervention service funding for a new contract amount of $146,565.00 for Fiscal Year 2016-2017 and a total contract amount not to exceed $1,100,761.00 through June 30, 2017; and
b) Determine that these activities are exempt from California Environmental Quality Act review per CEQA Guidelines Section 15378(b)(5) since the recommended actions are government administrative activities which do not involve commitment to any specific project which may result in potentially significant physical impact on the environment.

Consider recommendations regarding a First Amendment to Anka Behavioral Health Incorporated’s contract for Fiscal Year 2014-2017, as follows:
a) Approve and authorize the Chair to execute a First Amendment to Anka Behavioral Health Incorporated’s contract, adding new language and changing the County Maximum Allowable (CMA), from $345.00 a day to Actual Cost with no change to the total maximum amount through June 30, 2017; and
b) Determine that the above actions are organizational or administrative activities of the government that will not result in direct of indirect physical changes in the environment, pursuant to section 15378(b)(5) of the California Environmental Quality Act guidelines.
Consider recommendations regarding amendments to "Chapter 26 - Parks and Recreation" of the County Code, as follows:
a) Consider and approve the adoption (second reading) of an Ordinance amending "Chapter 26 - Parks and Recreation" of the County Code; and
b) Approve a Notice of Exemption pursuant to the California Environmental Quality Act (CEQA) guidelines, Section 15061(b) (3), finding that the Ordinance is not subject to CEQA because of the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment, and further find that there is no possibility that the enactment of the Ordinance may have a significant effect on the environment.
Consider recommendations regarding the Santa Maria Senior Apartments reservation of HOME and or In-Lieu funds, Fifth District, as follows:
a) Approve a preliminary reservation of County funds for the Santa Maria Senior Apartments project that will: be in an amount not to exceed $580,000.00; consist of HOME funds and/or In-Lieu Funds in specific amounts to be determined by the Board at a later date; and be released if People’s Self Help Housing Corporation does not receive notification of an award of state low-income housing tax credits for the project by October 31, 2016;
b) Authorize the Director of the Community Services Department to sign a letter to the project applicant indicating the approved reservation; and
c) Determine that the approval of the reservation is not the approval of a project that is subject to environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15378(b)(4), finding that the actions are not a project as they are the creation of government funding mechanisms or other government fiscal activities which do not involve any commitment to any specific project which may result in a potentially significant impact on the environment, and direct staff to file a Notice of Exemption.
Consider recommendations regarding the Community Choice Energy Updates, as follows:
a) Receive and file a briefing on the Community Choice Energy progress updates;
b) Approve and authorize the Chair to execute an Agreement for Services of Independent Contractor with Willdan in the amount not to exceed $220,756.00 for a feasibility study of community choice aggregation;
c) Authorize the Community Services Director or designee to amend the Agreement for Services of Independent Contractor by extending the term for a period not to exceed 6 months; and
d) Determine that the recommended actions do not constitute a project subject to environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15262, as the actions involve only feasibility or planning studies for possible future actions which the Board has not approved, adopted, or funded and does not have a legally binding effect on later activities, and direct staff to file a Notice of Exemption.
Consider an amendment to the 2016 Board of Supervisors' Schedule of Meeting Dates and Locations by adding a Special Meeting on Monday, May 23, 2016 in Santa Barbara and by adding a Regular Meeting on Tuesday, July 19, 2016 in Santa Barbara.
Consider recommendations regarding the Audit Reports for the Northern Branch Jail Projects (AB900 and SB1022) for Fiscal Years ended June 30, 2014 and June 30, 2015; Third District, as follows:
a) Receive and file the County of Santa Barbara’s AB900 North Branch Jail Construction Project Financial and Performance Audit from inception, January 15, 2013 through June 30, 2014;
b) Receive and file the Statement on Auditing Standards (SAS) 114 report (Auditor’s Letter to the County’s Governing Body) for AB900 for the period ending June 30, 2014;
c) Receive and file the County of Santa Barbara’s AB900 North Branch Jail Construction Project Financial and Performance Audit from inception, January 15, 2013 through June 30, 2015;
d) Receive and file the County of Santa Barbara’s SB1022 Adult Local Criminal Justice Facilities Construction Project Financial and Performance Audit from inception, October 21, 2014 through June 30, 2015;
e) Receive and file SAS 114 report for AB900 for period ending June 30, 2015 (Auditor’s Management Letter);
f) Receive and file SAS 114 report for SB1022 for period ending June 30, 2015 (Auditor’s Management Letter); and
g) Determine that acceptance of the annual report is not a “project” as defined by the California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(5), as it is an administrative activity that will not result in direct or indirect changes in the environment, and approve and direct staff to file the attached Notice of Exemption on that basis.
Consider recommendations regarding the Award to Ravatt, Albrecht & Associates, Inc. a Professional Services Agreement (PSA) to produce Design-Build Bridging Documents for New Cuyama Fire Station 41, Project No. 8751, First District, as follows:
a) Approve use of the design-build project delivery method to design and build the New Cuyama Fire Station 41, Project No. 8751, in accordance with Public Contract Code Section 22162;
b) Approve and authorize the Chair to execute the Professional Services Agreement (PSA) with Ravatt, Albrecht & Associates, Inc., a local firm, in the amount of $156,380.00 to provide Architectural Design and Engineering services to produce the design-build bridging documents for the New Cuyama Fire Station 41, Project No. 8751;
c) Authorize the General Services Director or designee to approve changes or additions to the professional services being performed under the PSA with Ravatt Albrecht & Associates in an amount not to exceed $15,638.00; and
d) Find that the proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15302(b), as it consists of replacement of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, and approve and direct staff to file a Notice of Exemption on that basis.

Consider recommendations regarding the California State Association of Counties Agreement for Welfare Client Data Systems Management for CalWORKs Information Network (CalWIN) for Fiscal Years 2016- 2019, as follows:
a) Approve and authorize the Chair to execute the Agreement Relating to Welfare Client Data Systems (WCDS) Management by and among the eighteen (18) WCDS Consortium counties, which includes the County of Santa Barbara, and the California State Association of Counties (CSAC) for the services of WCDS management staff for the period of July 1, 2016 through June 30, 2019 in an amount not to exceed $747,245.00 for County’s share of the WCDS Consortium’s cost; and
b) Determine that the approval and execution of the Agreement is not the approval of a project that is subject to environmental review under the California Environmental Quality Act (CEQA), pursuant to CEQA Guidelines section 15378(b)(4), finding that the project is a creation of a governmental funding mechanism or other government fiscal activity, which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment.
Consider recommendations regarding an Agreement with Casa Pacifica Centers for Children and Families for Child Welfare Services (CWS) Senate Bill 163 (SB 163) Wraparound Services, as follows:
a) Approve and authorize the Chair to execute an Agreement with Casa Pacifica Centers for Children and Families (Casa Pacifica) in the amount not to exceed $693,904.00 to provide CWS SB 163 Wraparound Services as a family-centered, community-oriented, culturally sensitive, strength-based, individualized alternative to sending foster children to, or keeping them in group home placements, for the period of July 1, 2016 through June 30, 2017; and
b) Determine under the California Environmental Quality Act (CEQA) Guidelines Section 15061 (b)(3) that this activity is exempt from review on the basis that it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment.
Receive and file the DNA Identification Fund Report for calendar year 2015.
Receive and file the Fiscal Year 2015-2016 Third Quarter (January - March 2016) report on the Treasurer’s Investment Pool, pursuant to Government Code Section 53646(b).

Hearing Requests
HEARING - Consider recommendations regarding the HOME Loan for Property Acquisition and Rehabilitation and the draft Fiscal Year (FY) 2012-2013 and FY 2014-2015 Action Plan Substantial Amendments, as follows: (EST. TIME: 15 MIN.)
a) Approve the sale of the Property by Life Steps Foundation;
b) Consider the County’s Right of First Refusal to purchase the Property at fair market value and determine that the County will not exercise its right to purchase the Property;
c) Approve Good Samaritan as buyer of the Property;
d) Receive and consider public comments on the draft FY 2014-2015 Action Plan Substantial Amendment received during a 30-day public comment period, which commenced on April 17, 2016 and concludes at the end of the May 17, 2016 public hearing on this item;
e) Approve FY 2014-2015 Action Plan Substantial Amendment to be submitted to Housing and Urban Development (HUD) that includes the provision of HOME funds to Good Samaritan to acquire and rehabilitate the Property;
f) Approve and authorize the Chair to execute a County HOME Loan Agreement, HOME Promissory Note and HOME Deed of Trust with Good Samaritan and provide $475,000.00 in HOME funds, of which $445,000.00 will to be used to acquire the Property and $30,000.00 will be used toward the costs to rehabilitate the Property;
g) Approve and authorize the Chair to execute a new County Regulatory Agreement that will restrict one (1) of the six (6) bedrooms at the Property for low-income persons with annual incomes not to exceed sixty-percent (60%) of area median income (AMI) and restrict five (5) bedrooms for persons with annual incomes not to exceed fifty-percent (50%) AMI for a period of fifteen and one-half (15.5) years;
h) Approve and authorize the Chair to execute an Assumption and Assignment Agreement of the Grant Agreement with Good Samaritan with the following modifications: 1) the six bedrooms will be income and rent restricted for households with annual incomes that shall not exceed sixty-percent (60%) of the area median income and 2) the restriction that occupancy is limited to persons with developmental disabilities is removed; and
i) Determine that the recommended actions are not the acceptance and approval of a project that is subject to environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378(b)(4), finding that the project is a creation of government funding mechanisms or other government fiscal activities, which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment, and direct staff to file a Notice of Exemption.

HEARING - Consider recommendations regarding a report on sex trafficking in Santa Barbara County, as follows: (EST. TIME: 30 MIN.)
a) Receive and file a report on sex trafficking in Santa Barbara County;
b) Provide other direction as appropriate; and
c) Determine that these actions are exempt from the California Environmental Quality Act (CEQA) pursuant to the CEQA Guidelines Section 15061 (b) (3), finding that the execution of these actions are covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment, and where it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment, the activities are not subject to CEQA.
HEARING - Consider recommendations regarding a report on options on the Assisted Outpatient Treatment Services (Laura’s Law), as follows: (EST. TIME: 1 HR. 30 MIN.)
a) Receive and file a report with further analysis of options and feasibility of implementing Assisted Outpatient Treatment for the parameters set forth in the Welfare and Institutions Code Sections 5345-5349.5 (AB 1421/Laura’s Law);
b) Provide staff with conceptual direction about one of the following options, or provide other direction, subject to annual appropriations, and direct staff to return at a later date, as follows:
Option 1:
Targeted service expansion: Expand targeted services to address the needs of individuals who are High Users of Multiple Systems (HUMS), including those who would potentially benefit from AB 1421; adding 15 Assertive Community Treatment (ACT) slots, 45 or more intensive outreach/case management, 20 or more beds safe and stable housing; No adoption of AB 1421/ Requested General Fund Cost annually $700,000.00 and a total program cost of $850,000.00 with estimated Medi-Cal revenue; or
Option 2:
Robust service expansion: Broad service expansion to address the needs of high risk or hard to reach HUMS clients: System Expansion; adding 30 ACT slots, 90 or more regional intensive outreach/case management, 40 or more beds safe and stable housing; No adoption of AB 1421/Requested General Fund Cost annually $1,375,000.00 and a total program cost $1,675,000.00 with estimated Medi-Cal revenue; or
Option 3:
AB1421 Pilot Project Implementation: Adoption of AB1421/Requested General Fund Cost annually $606,888.00 and a total program cost of $755,496.00 with estimated Medi-Cal revenue (estimate about 10 persons served); or
Option 4:
Full AB 1421 implementation: Adoption of AB1421; Requested General Fund Cost annually $2,047,692.00 and a total program cost $2,384,387.00 with estimated Medi-Cal revenue (estimate about 75 persons evaluated and 38 served); or
Option 5:
No Service Expansion: No adoption of AB 1421; No additional annual cost.
c) Determine that the above actions are exempt from the environmental review per California Environmental Quality Act (CEQA) Guideline Section 15378 (b)(5), since they are government administrative activities that do not involve a commitment to a specific project that may result in a potentially significant effect on the environment.
COUNTY EXECUTIVE OFFICER’S RECOMMENDATION: POLICY
Consider recommendations regarding a Fee Ordinance for Fiscal Year (FY) 2016-2017 adjusting the Santa Barbara County Department of Behavioral Wellness Published Charges for inpatient and outpatient mental health services, effective 30 days after adoption by the Board, as follows:

HEARING - Consider recommendations regarding the Verizon Telecommunication Facility at Rancho Alegre, Ordinance 661 Consistency Rezone, Case No. 16RZN-00000-00002 and 14CUP-00000-00016, located at 2680 Highway 154, Third District, as follows:

HEARING - Consider recommendations regarding Measure A Program of Projects for Fiscal Year 2016-2017, as follows: (EST. TIME: 30 MIN.)
a) Adopt a Resolution approving the Measure A Five-Year Local Program of Projects for Fiscal Years 2016-2017 through 2020-2021, for submittal to the Santa Barbara County Local Transportation Authority for acceptance;
b) Reaffirm the existing distributions of Measure A revenues: 50 percent population and 50 percent lane miles for the South Coast, and 100 percent lane miles for North County;
c) Reaffirm Resolution 10-101, which establishes priorities and policies for the use of the local portion of the one-half cent sales tax for the transportation needs in Santa Barbara County;
d) Direct staff to prepare Fiscal Year 2016/2017 Road Maintenance Annual Plan based upon approved Measure A distribution formula; and
e) Determine that the proposed actions are administrative and other fiscal activities that do not involve commitment to any specific project, and are therefore not a project as defined by State California Environmental Quality Act Guidelines Section 15378, and approve and direct staff to file a Notice of Exemption on that basis.
