Water Board Reappointment of David E. Mlynarski Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, approve the reappointment of Mr. David E. Mlynarski to the Water Board with a six-year term of office ending in May 2032. Council Office staff have verified the appointee is a registered voter within the City.

Proposed Fiscal Year 2026-27 Annual Action Plan for the Community Development Block Grant, HOME Investment Partnership and Emergency Solutions Grant Programs (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: Conduct a Public Hearing to obtain citizens’ comments on the proposed Fiscal Year 2026-27 Annual Action Plan for the Community Development Block Grant, HOME Investment Partnership, and Emergency Solutions Grant Programs; and Consider any necessary changes to the proposed Fiscal Year 2026-27 Annual Action Plan and direct staff to return on June 17, 2026, with the final Annual Action Plan for consideration prior to submittal to the United States Department of Housing and Urban Development Authorize the Director of Finance and Management to adjust the Fiscal Year 2026-2027 Budget appropriation to align with the Fiscal Year 2026-27 Annual Action Plan allocation; and Authorize the City Manager or designee to take any further actions and execute any further documents as necessary to effectuate the submittal of the Fiscal Year 2026-2027 Annual Action Plan and certification to the U.S. Department of Housing and Urban Development.

Introduction of Ordinance No. MC XXX Amending Various Sections of Title 15 of the San Bernardino Municipal Code Adopting the New (2025) Building Code (All Wards) (Staff is Requesting to Continue this Item to June 3, 2026) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California take the following action: Hold a Public Hearing; and Introduce and read by title only and waive further reading of Ordinance No. MC-xxx of the Mayor and City Council of the City of San Bernardino, California, adopting the new Municipal Code language and approve use of the new 2025 California Building Code and other minor changes to Chapter 15 of the San Bernardino Municipal Code; and Schedule Ordinance No. MC-xxx for Adoption on June 17, 2026.

Specific Plan Amendment 23-01 and Subdivision 23-05 (Tentative Tract Map 20595) University Hills Specific Plan Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: Adopt Resolution 2026-042 approving Subdivision No. 23-05 (Tentative Tract Map No. 20595) to allow the subdivision of a 404.3-acre site into 327 single-family residential lots; and adopting the Addendum to the Final Subsequent Environmental Impact Report and Mitigation Monitoring and Reporting Program (SCH #2007071155) in compliance with the California Environmental Quality Act. Introduce, read by title only, and waive further reading of Ordinance No. MC-1665 of the Mayor and City Council of the City of San Bernardino, California (a) Approving Specific Plan Amendment 23-01, amending the development standards and guidelines of the original development plan and reducing the number of proposed single-family residential lots from 980 to 327 within the University Hills Specific Plan (APNs: 0265-041-12, 0265-051-12 and -13; 0265-061-16; 0265-011-06, -07, and -08; 0265-051-09; and 0265-021-13) (Attachment 5 and 6); and (b) dissolving Development Agreement No. 08-02 (Attachment 1 and 10). Approval of Amendment No. 2 to the Professional Services Agreement with Redwood Private Security, LP to Incorporate Regal Theatre Security Services into the Citywide Contract and Approval of an Additional Professional Services Agreement for Navigation Center Construction Site Security Services (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: Approve Amendment No. 2 to the Professional Services Agreement with Redwood Private Security, LP to incorporate security services for the Regal Theatre into the existing Citywide contract and increase the total not-to-exceed compensation by $80,000; and Approve a Professional Services Agreement with Redwood Private Security, LP for the provision of unarmed security services at the Navigation Center construction site in the amount of $291,667.20, utilizing the same competitively procured rates established under the original agreement; and Authorize the City Manager to execute all related documents necessary to effectuate Amendment No. 2 to the Citywide Agreement and the Professional Services Agreement for the Navigation Construction site.

Amendments to Professional Services Agreements for Legal Services (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, authorize the City Manager or designee to execute: Third Amendment to the Professional Services Agreement with Atkinson, Andelson, Loya, Ruud and Romo for representation in the Christina Nedrebo v. City of San Bernardino, et al., Superior Court Case No. CIVSB2402094 increasing the not-to-exceed amount from $400,000 to $750,000. Second Amendment to the Professional Services Agreement with Carpenter, Rothans and Dumont for representation in the Manuel Zamudio, Jr. v. City of San Bernardino, et al., United States District Court Case No. 5:24-cv-01747-MWF-SHK increasing the not-to-exceed amount from $100,000 to $160,000. Second Amendment to the Professional Services Agreement with Carpenter, Rothans and Dumont for representation in the Manual Ortiz v. City of San Bernardino, et al., United States District Court Case No. 5:24-cv-00118-SB-SP increasing the not-to-exceed amount from $100,000 to $250,000.

Adopt A Resolution Accepting the Corporation for National and Community Service’s AmeriCorps Senior Retired Volunteer Program (RSVP) grant in the amount of $70,477 for FY 2025-2028 Year two of a Three-Year Grant Award (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California Adopt Resolution No. 2026-043: Authorizing the City Manager to approve the ratification of the submission of a continuation grant application budget for year two of a three-year grant (2025-2028) through the Corporation for National and Community Service’s AmeriCorps Seniors Retired and Senior Volunteer Program (RSVP); and Authorizing the City Manager to accept the grant award in the amount of $70,477 and cash match amount of $ 76,354; and Authorizing the City Manager or their designee to conduct all negotiations, signing and submittals of necessary documents to receive grant awards; and Authorizing the Director of Finance and Management Services to appropriate the grant funds for the period of April 1, 2026 ($17,619.25 in FY 25-26) through March 31, 2027 ($52,858.75 in FY 26-27).

Adoption of Ordinance No. MC – 1663 Amending Chapter 10.16.120 of the San Bernardino Municipal Code (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California adopt Ordinance No. MC-1663, amending Section 10.16.120 of the San Bernardino Municipal Code by adding subsection 10.16.120(B)(1) to prohibit the parking or standing of detached commercial trailers in non-residential districts and to authorize the immediate issuance of citations for violations.

Approve Goods Purchase Agreements with Fairview Ford for the Purchase of Police Fleet Vehicles for an Amount not to Exceed $270,000. Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, authorize: 1. The City Manager to execute a Goods Purchase Agreement with Fairview Ford for an amount not to exceed $270,000 for the purchase of police fleet vehicles, 2. The Director of Finance and Management Services to issue a purchase order to Fairview Ford for an amount not to exceed $270,000.

Authorize a Professional Services Agreement with Axon Enterprise Incorporated in an Amount Not to Exceed $4,150,000, for a Five-Year Period Beginning May 1, 2026, Through June 30, 2031, (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: Authorize the City Manager to execute a Professional Services Agreement with Axon Enterprise Incorporated for an amount not to exceed $4,150,000, with a term beginning May 1, 2026, through June 30, 2031; and Authorize the Director of Finance and Management Services to issue a purchase order to Axon Enterprise Incorporated for $767,860.50.

Award of Construction Agreement to Voltaire Engineering, Inc. for 2372 E. Lynwood Drive (Church Parking Lot) Storm Drain Repair in the amount of $132,600.00 and Contingency of $19,890.00 for a Total Amount of $152,490.00 (Ward 7) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California to: Approve the award of a Construction Agreement with Voltaire Engineering Inc., in the amount of $132,600.00 for 2372 E. Lynwood Drive Storm Drain Repair (Project); and Authorize the construction contingencies, construction management, and administrative costs in the total amount of $19,890.00 for the Project, bringing the total Project budget to $152,490.00; and Authorize the City Manager or designee to execute all documents with Voltaire Engineering, Inc.; and Authorize the City Manager or designee to expend the contingency fund, if necessary, to complete the Project.

Contract Amendment No. 2 Approval – Mt. Vernon Storm Drain Project (Ward 6) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: Approve Amendment No. 2 to the Design Services Agreement with Onward Engineering in the amount of $6,900.00, for a total contract amount of $171,439.50 from Storm Drain DIF funding.

California’s Creative Economy Strategic Plan (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino receive a presentation from California Creative Economy.

Introduction of Ordinance MC-1665 Amending Chapter 8.60 (Fireworks) and Chapter 8.61 (Prohibited Fireworks) of the San Bernardino Municipal Code to add Social Host Regulations and Cost Recovery Provisions to the City’s Fireworks Laws (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino California, Introduce, read by title only, and waive further reading of Ordinance No. MC-1665, amending Chapter 8.60 (Fireworks) and Chapter 8.61 (Prohibited Fireworks) of the San Bernardino Municipal Code to add social host regulations and cost recovery provisions to the City’s fireworks laws. Schedule the Adoption of Ordinance MC-1665 for the next regular meeting of May 20, 2026.

Adoption of the San Bernardino Parks Master Plan Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, adopt the Parks Master Plan and adopt Resolution No. 2026-044: Adopting the City of San Bernardino Parks Master Plan as the City’s guiding document for planning, developing, maintaining, and investing in parks, recreation facilities, aquatics amenities, trails, and open space; and Authorizing staff to use the Park Master Plan to guide capital improvement planning, operational strategies, grant applications, and project prioritization.
