ORDINANCE #16-2026 The City of Battle Creek Ordains: That the following sections are introduced: Section 1. The proposed Ordinance, amending Chapter 298, "Municipal Court" to "Administrative Hearing Bureau", attached here, is adopted. Section 2. Should any section, clause, or phrase of this Ordinance be declared invalid, the same shall not affect the validity of the Ordinance as a whole, or of any other part other than the part declared to be invalid. Section 3. All ordinances or parts of ordinances, in conflict with any of the provisions of this Ordinance, are hereby repealed, saving any prosecution, criminal or administrative appeal pending on or violation cited on or before the effective date of this Ordinance, which shall remain subject to ordinance provision existing at the time of the alleged violation. Section 4. The Battle Creek City Commission finds that this Ordinance is immediately necessary for the preservation of public peace, health, morals, safety, and/or welfare, and this Ordinance shall have immediate effect upon adoption, in accordance with the provisions of Section 4.3(C) of Chapter 4 of the Battle Creek City Charter. | attachments=1 | reports=1

RESOLUTION NO. 426 Resolved by the Commission of the City of Battle Creek: That the following sections are adopted: Section 1. A Proposed Ordinance, 14-2026, to amend Chapter 1240 Zoning Districts and Map, Chapter 1241 Schedule of Regulations, and Chapter 1250, Section 1250.04 Form-based development standards for T-3, T-4, and T-5 of the zoning code to add a T-6 zoning district that will encompass part of the Lakeview District; specifically, those properties that are currently zoned B-2 and make minor corrections to each Chapter. The new district will include regulations that reflect the recommendations of the Lakeview District Subplan to create a mixed-use walkable district. Section 2. Should any section, clause or phrase of this Ordinance be declared to be invalid, the same shall not affect the validity of the Ordinance as a whole or any part thereof, other than the part so declared to be invalid. Section 3. RESOLUTION NO. 435 Resolved by the Commission of the City of Battle Creek: That the urban transportation planning regulations, implementing sections of the Infra­structure Investment and Jobs Act (IIJA) federal legislation, require that each urbanized area, as a condition of receipt of Federal capital or operating assistance, have a continuing, cooperative, and comprehensive urban transportation planning process that results in plans and programs consistent with the comprehensively planned devel­opment of the urbanized area; and In the Battle Creek urbanized area, the continuing, cooperative, and comprehensive transportation planning process is being conducted by the Battle Creek Area Transportation Study (BCATS) Policy Committee, a forum for cooperative transportation decision-making by principal elected officials of local government, developed under federal guidelines for purposes of urban transportation planning conduct; and The Battle Creek Area Transportation Study annually develops a Unified Work Program identifying activities and costs necessary for the conduct of the urban transportation planning process; and Transportation planning funds, indirectly available from the U.S. Depart­ment of Transportation, are utilized to carry out the activities defined in the Unified Work Program; and These funds, available under the federal legislation as a Consolidated Planning Grant from the Federal Highway Administration (which includes funds flexed from the Federal Transit Administration to FHWA) require a local match of 18.15%, and The Policy Committee of the Battle Creek Area Transportation Study has recommended that the local match required to assure the timely conduct of the Study be determined and provided for in the following manner: 1. The reimbursement schedule to be used for participating agencies (those doing BCATS work will be paid 100% of their total charge). BCATS staff office costs will be reimbursed 100%. 2. The formula for computing the local funds will be based on the urbanized area population for FHWA funding (applied to road agencies) and minimum required local match for FTA funding (applied to the TACC only). The local agencies will contribute the local share for their own activities within the BCATS program as noted on the attached table (see 3. below). 3. Distribution for local match funding is shown on the attached table, which is the same as Schedule D in the FY 2027 Unified Work Program. It has been determined that the total local share requirements for the operation of the Battle Creek Area Transportation Study’s work program for fiscal year 2027 will be $63,920; The City of Battle Creek agrees to participate in the funding of the local share costs of the Battle Creek Area Transportation Study’s work program for fiscal year 2027 (October 1, 2026 - September 30, 2027) by providing 55.98% of the local match required for BCATS’ staff costs, plus $1,815 for costs specific to the City of Battle Creek’s participation in the BCATS program; The total local contribution for the City of Battle Creek for FY 2027 will be $28,322; The City of Battle Creek agrees to submit to the Battle Creek Area Transportation Study office (601 Avenue A, Springfield, MI 49037 RE: Fund No. 230.594.2321) payment of local match share no later than January 1, 2027; The City of Battle Creek agrees this Resolution becomes effective at such time as all other local study participants providing finan­cial support pass resolutions of financial commitment in the proportion and manner described in this Resolution. | attachments=2 | reports=1

RESOLUTION NO. 436 Resolved by the Commission of the City of Battle Creek: That the proposed Housing Strategy Subplan is approved for distribution for review and comment, pursuant to the Municipal Planning Act (PA 33 of 2008). RESOLUTION NO. 437 Resolved by the Commission of the City of Battle Creek: That the amended water and sewer rates presented in Exhibit 1 are authorized for calculating customer charges for service. The rates are based on an analysis of the water and sewer systems conducted by the City's consultant, Stantec Consulting Services, and apply to the City of Battle Creek, City of Springfield, Charter Township of Bedford, Charter Township of Emmett, Leroy Township, Pennfield Township, and the City of Marshall; and Upon approval, the amended rates will be added to the Fee, Bond and Insurance Schedule, superseding the rates specified in Exhibit 1 of 2026 Resolution 414, with the prior FY2025 rates to remain valid until the new rates go into effect as listed. The Battle Creek Codified Ordinances states that the rates and charges established by the City for water and sewer services are to be set forth in a schedule which is to be enacted by the City Commission from time to time by Resolution.
